Homicide Charges in Tennessee

Homicide is defined as the unlawful killing of another person, and there are many different charges that could be filed against you in relation to causing a death.   • Second-degree murder: Second-degree murder is defined by Tennessee law as the knowing killing of another. The difference between first-degree and second-degree murder is the lack of premeditation for second-degree murder. The offense is a Class A felony that carries 15 to 60 years of incarceration;
  • Voluntary manslaughter: Voluntary manslaughter is sometimes called third-degree murder in some jurisdictions, and it refers to killing another due to provocation in the heat of a moment. Voluntary manslaughter is a Class C felony that could lead to up to 15 years in prison;
  • Vehicular homicide: If you were driving so recklessly that you caused an accident in which another was killed, you could face charges for vehicular homicide. Drag racing and drunk driving are statutorily considered to be reckless enough for such charges in the event of a fatality. A prior history of DUI or previous conviction of vehicular homicide could result in the charges being increased to aggravated vehicular homicide. The severity of the charges and the associated penalties depend on the circumstances.

It is also possible to face charges for criminally negligent homicide which is a Class E felony and carries a prison sentence of up to six years. Reckless homicide is a Class D felony and carries a prison sentence of up to 12 years.
